JUDGMENT Bhairo Prasad, Member. - This reference has been made by the Additional Commissioner, Varanasi Division, vide his recommendation dated 11.9.1987 in a proceeding under Section 122B against the order of the trial court dated 4.1.1982. 2. No objection has been filed against this recommendation. No body has appeared. Perused the record. 3. The Additional Commissioner has recommendation that the notice in form 49-K was not issued in the prescribed proforma, hence the whole proceeding is null and void. I agree with this recommendation of the Additional Commissioner, therefore, I set aside the order of the trial court dated 4.1.1982 and remand the case for fresh trial after giving a notice in prescribed proforma.
