JUDGMENT Bhairo Prasad, Member. - This reference has been made by Additional Commissioner vide his recommendation dated 13.8.1987 against the order passed by the Assistant Collector in proceeding under Section 122-B of U.P. Act No. 1 of 1951 dated 25.7.1983. 2. No objection has been filed against this recommendation. No one also appeared. Perused the record. 3. The learned Additional Commissioner has recommended that the notice was not properly served and issued on the revisionist, therefore, the whole proceeding was vitiated. I agree with this recommendation of the Additional Commissioner and set aside the order of the trial Court and remand the case to the trial court to decide it afresh in accordance with the direction of the Additional Commissioner.
