JUDGMENT Bhairo Prasad, Member. - These two reference have been made by the Additional commissioner, Varanasi Division, Varanasi vide his recommendation dated 10.11.1987 in a proceeding under Section 122-B of U.P. Act No. 1 of 1951. 2. No one is present in this court from either side. Perused the record. 3. This proceeding started on the report of lekhpal on 1.6.1981. The revisionist Ramjiawan was found in possession of plot no. 649 area 1-0-5 and revisionist Kishun Chandra was found in possession of plot no. 643 area 1-3.15 of village Hriaon, Taluka Chauthar, Pergana and Tahsil Bhadohi district Varanasi. The notice were issued to them in form 49-K on 1.6.1981. They appeard and pleaded that they are in possession of the above plots from more than 20 years. They are landless labourers belonging to scheduled caste and have acquired right under Section 122-B (4-F) of U.P. Act No. 1 of 1951. The trial court after taking the evidence came to the conclusion that their possession is not above of the period to perfect the right, therefore, he ordered that they should be ejected and damages of Rs. 810 was imposed on Ram Jiawan and Rs. 37/- to Kishan Chand. These two proceedings were decided by the trial court but the Additional Commissioner has made the reference by a common recommendation dated 10.11.1987, therefore, they are being disposed of by common judgment. 4. The trail court has not given them the benefit of Section 122-B (4-F) of U.P. Act No. 1 of 1951 on account of the fact that they were not in possession more than 10 years. The notices were issued on 1.6.1981. Now it will be presumed that at least in possession form that date. Now there has been amended provision of law the right has been conferred upon them if they were found in possession on 30.6.1985 or before that. Since the notices were issued to them in 1981, hence they will be deemed that the land has been settled with them, therefore, a proceeding under Section 122-B of U.P. ACt No. 1 of 1951 against revisionists for ejectment is quashed and they are declared that they have been deemed to be admitted as non-transferable bhumidhars of the plots in dispute. Let record be corrected accordingly. Recommendation of the references is modified in accordance with this finding. This order shall govern References No. 31 and 32 of 1987-88/Varanasi.
