Judgment A. M. AHMADI ( 1 ) DELAY condoned. ( 2 ) SPECIAL leave granted. ( 3 ) HEARD learned counsel on both sides. ( 4 ) BY the impugned order of 26-10-1989 the High Court has quashed the order challenged before it as not being a speaking order. We have perused the order of 7-11-1978. The opening part of that order reads as under: "due to cancellation of result of selection of operating staff made by the selection committee. . . dated 31-8-1978 the services of the following staff are hereby terminated. . . . "the reason for termination is writ large on the order itself, namely, cancellation of result of selection of operating staff. It is, therefore, not right to say that the order was not a speaking order. The reason for termination is clearly given and if the department is able to sustain the ground on which the termination was effected by giving the particulars in that behalf, the High Court would have to consider the same on merits. ( 5 ) IN the result, we allow this appeal, set aside the impugned order of the high Court and remit the matter to the High Court for disposal on merits. There will be no order as to costs.
