JUDGMENT The applicant is in custody in Crime No.44/92 originally registered for the offences under sections 147, 148, 323, 324 and 294/149 I.P.C. The report of the incident was lodged by one Suresh, who is also an injured person in the incident Ramesh, the deceased was assaulted on his head by Co-Accused Raja Ram. After a few days of the incident, injured Ramesh having died, the offence was converted to be one under section 302 I.P.C. The allegation against the applicant is not of causing any injury to the deceased but he is said to have caused the injury to witness Suresh, the complainant, which has been found to be simple in nature as the case diary does not contain the X-ray report. In the circumstances above stated, the co-accused Prem Narayan has been enlarged on bail by this Court and the case of the applicant is not distinguishable, it is directed that if the applicant submits a personal bond in the sum of twenty thousand rupees with one surety in the like amount to the satisfaction of the C.J.M., Gwalior, be shall be enlarged on bail.
