JUDGMENT 1. - This is 5th bail application on the ground that directions of this Court have not been followed and the trial is further delayed. It is true that this Court has observed that trial in this case should be completed by 31st of March, 1993 and an explanation of the learned Judge had also been called and nutter referred to the Registrar (Vigilance) to look into the matter. This could be a ground for granting the bail as I had taken this view in several cases, but in this case I find that lately the learned Counsel for the accused 'himself took time and now get the case adjourned on the ground that be wants to move an application for transfer. Ex facie there does not appear to be a valid ground for transfer of the case, but in view of the fact that I have already called for the explanation of the judicial officer concerned seeking his explanation about interpolations in the order sheets and in the marginal note, may be that the accused can entertain unnecessary apprhensious and keeping in mind the principal that justice should not only be done but it should appear to have been done, I deem it proper to suo moto order the transfer of this case from this Court to the Court of the Sessions Judge, Alwar. The transfer of the case is in no manner done in order to harm the reputation of the learned Judge or any other such purpose. But absolutely keeping in line with the order I have earlier passed about the order sheets, more particularly because the matter was referred to the Registrar (Vigilance). 2. I would therefore direct, under the inherent powers of this Court, in order to secure the ends of justice, withdraw this case from the Court of learned Addl. Sensions Judge No.1 Alwar and send it to the Court of learned Sessions Judge, Alwar who shall record the statement of the accused and give him a week's opportunity to produce the witnesses if he wants to produce any and deliver the judgment before the end of this month. 3. In view of the aforesaid, this bail application is dismissed. 4. A copy of this order shall be sent to learned Sessions Judge, Alwar today.
