JUDGMENT : RAVI S. DHAVAN, J. 1. On this petition on behalf of the Respondent Nos. 1 and 7 a request was made by the Standing Counsel to adjourn the matter so that he could seek instructions. 2. The issue is simple. The Petitioner is a teacher at the H.M.S. Islamia inter College, Etawah has retired on 12 January 1993. The law stipulates by Sub Clause 21 of Chapter-III of the regulations framed under we intermediate Education Acts, 1921 that should be teacher retire mid session he would be permitted to continue to see the close of the academic session ending on 30 June. 3. Learned Standing Counsel, present, submits that a letter has already gone to the District Inspector of Schools, Etawah, Respondent No. 1, being (jitter m) (sic) 895/B dated 31 March, 1993 but no instructions have been received. 4. In these circumstances, that neither a counter affidavit is-forthcoming nor any instructions have been received by the Standing Counsel, this Court will assume that the Respondent Nos. 1 and 2 have nothing to report. The law, thus, will take its own course and the Petitioner Sri Virendra Singh Verma teacher at the aforesaid institution will continue to serve, unless otherwise his services are dispensed with in accordance with law, until 30 June, 1993, that is the close of the academic session 1992-93 and he would be entitled to his salary during the tenure of his service. 5. The Petition is, thus, allowed but there will be no orders on costs.
