ORDER : 1. In view of our judgment pronounced today in Civil Appeal No. 977 of 1991 and following the reasoning therein we allow this appeal, set aside the judgment of the High Court and dismiss the writ petition of the respondent filed before the High Court with costs. We quantify the costs as Rs. 10,000/-
