Order We have heard counsel for the parties. 2. While we appreciate the vehement stand of Mr. Shukla that the democratic process cannot be defeated for political considerations and that it is not open to the Government to nominate all and sundry on the Municipality which is a substitute for the duly elected representatives to the municipality, we do Dot consider it necessary to go into these questions at this stage, particularly in view of the order which we propose to make. 3. In similar circumstances, we have disposed of C.W.J.C. No. 8378 of 1992 by order dated 27.11.1992. We have observed that the democratic process cannot be stalled indefinitely, and the practice of substituting nominated members in place of elected representatives is antithetical to a democratic way of governance. In that case also we have directed that the election must be held and concluded latest by 31st May, 1993. Counsel for the petitioners has brought to our notice the fact that this Court in C.W.J.C. No. 3582 of 1992 by order dated 13.11.1992 directed to hold election after publishing the programme by 30th November, 1992. It was stated on behalf of the Government in that case that the Government had already sanctioned funds for holding such election. 4. In the matter of fixing of dates for holding of election there can be no question of binding precedent, inasmuch as it cannot be said as a matter of law that in all cases the programme must be notified within a certain period. Even if the programme is published within two weeks from today, the process of election will still take some time. 5. We have, therefore, after considering the submissions urged on behalf of the parties, come to the conclusion that some time should be given to the Government to enable it to bold election. We, therefore, direct that the process of election should be commenced and concluded latest by 31st of May 1993. If the election is not held within this period, apart from other consequences that may follow, the present Committee shall stand superseded automatically on the 31st of May 1993. 6. This application is disposed of in the above terms.
