JUDGMENT 1. - The petitioners are husband, father-in-law, and mother-in-law, respectively, of Smt. Manju Devi, Complainant in the case. The offences for which the F.I.R. has been registered are under Sections 498-A and 406, Indian Penal Code Smt. Manju Devi was married to the petitioner No. 1, Prem Chand, in April, 1990 and further according to her, she has been tortured for bringing less dowry. She was turned out of the house when she was pregnant and then she was threatened after delivery of child. Most of the items claimed by her have been returned by the petitioners and some articles/items remained to be returned as is clear from the case. 2. The learned counsel for the accused-petitioners has contended that their house has been sealed by the police but from the diary of the case, this fact is not borne out according to the learned Additional Public Prosecutor and no seal has been put on the lock on the house. 3. It is also contended that father and brother of Smt. Manju Devi are in police service and therefore, the police has taken speedy action in the matter. 4. At present, I have to go by the facts of the case and considering the nature of the allegations, it can be said that the accused petitioners can be released on anticipatory bail on appropriate conditions.The S.H.O./Arresting Officer/Investigating Officer, Police Station Alwar-Gate, Ajmer in FIR No. 25/93 is, therefore, directed that in the event of arrest of the accused petitioners, namely Prem Chand, Kishan Lal and Smt. Gyarsi Bai w/o Kishan Lal, they shall be released on bail, provided each of them furnishes a personal bond in the sum of Rs. 5000/- (Rs. Five thousand) with one surety in the like amount to his satisfaction, on the following conditions:- 1. that the petitioners shall make themselves available for interrogation by a police officer as and when required; 2. that the petitioners shall not directly, or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, so as to dissuade him from disclosing such facts to the court or any police officer; 3 that the petitioners shall co-operate with the police in the recovery of articles claimed by Smt. Manju Devi; and 4. that the petitioner shall not leave India without the previous permission of the court. *******
