JUDGMENT By this petition under Art.226 of the Constitution the petitioner, who is a subscriber of telephone No.410055 installed at petitioner's factory in Indore, challenges telephone bills dated.1.10.92, filed as annexure 'B' and 'c' to the petition, as extra-ordinary exhorbitant, and prays for a direction to the respondents to immediately restore its telphone cannection, which has been unjustifiably disconnected. The petitioner by letter dtd.14.10.92 Anx.'D' lodged a complaint but to no avail, hence this petition. Smt. Shubhda Waghmare, learned counsel appearing for the petitioner, submitted that the S.T.D. calls as contained in the bills are not only unrelated to the petitioner but have been made in the night beyond normal factory working hours and their duration is also unduly long extending over more than an hour. Learned counsel maintained that in face of strict security arrangement and night watch at the factory, there is no likelihood of any misuse of the telephone during night. Shri B. G. Neema, learned standing counsel for the Union of India, who has been supplied an advance copy of the petition even while not agreeing to the contention as advanced by the petitioner's counsel, agreed to the extent that the matter can be looked into by the arbitrator and the Act also provides for reference of such disputes to the arbitrator. Learned counsel for the petitioner urged that the telephone connection must be immediately restored pending reference to the arbitrator. In view of the foregoing submissions made by the learned counsel for the parties, that let the dispute of excessive billing be referred to an arbitrator, u/s 7/B of Indian Telegraphs Act for his adjudication and award. In the meanwhile the respondents are ordered to restore petitioner's telephone connection conditional upon the petitioner depositing Rs.l0,000/- (ten thousand) with the department apart from what has already been paid towards the bills within a week from the date of this order. With this direction the petition stands finally disposed with no order as to costs.
