JUDGMENT 1. - Heard. 2. The petitioner, who is facing trial in Cr. Case No. 65/81 for the offences under sections 353, 332, 342 and 336 Indian Penal Code in the court of Additional Munsif and Judicial Magistrate No. 2, Bikaner was on bail. He remained absent on 19-5-1982 with the result that his bail bonds were forfeited. Subsequently, he was granted bail on 5-7-1982. On 11-3-1983, the petitioner again absented himself and his bail bonds were forfeited. He was again granted bail on 3-6-1983. Thereafter he remained absent on 13-4-1987 and his bail bonds were again forfeited. On 18-7-1989, he was declared as an absconding and non-bailable warrant was issued against him. He appeared in the court on 20-6-1990 and was again bailed out. Thereafter on 2-8-1991, he absented himself and could be apprehended on 3-8-1993. The learned Magistrate as well as the learned Sessions Judge have dismissed the bail applications filed on behalf of the petitioner. 3. Mr. Bhagwati Prasad, the learned counsel for the petitioner has clearly conceded that in this case, the petitioner has misused the indulgence granted by the Court by releasing him on bail, but has submitted that since the petitioner is an illiterate poor person and he had gone out side to earn the livelihood and as such he could not attend the court on the appointed date?. He has further submitted that in this case as many as 16 prosecution witnesses have already been examined, who have turned hostile and that the complainant has also compounded offence under section 342 Indian Penal Code and that compromise has been attested by the learned trial court. He further assures that the petitioner in future shall now be attending the court regularly and will not make any default. 4. Hence, keeping in view all the facts and circumstances of the case, I feel inclined to give one more opportunity to the petitioner to remain on bail during trial of this case. 5. I accordingly allow this petition and order that petitioner Shankar Lal be released on bail provided he executes his.personal bond for an amount of Rs. 9000/- (Rs. nine thousand) and furnishes three sound and substantial sureties for an amount of Rs. 3000/- each to the satisfaction of the learned Additional Munsif and Judicial Magistrate No. 2. Bikaner for his regular appearance before him in Cr.
