JUDGMENT G.C. Bharuka, J. There are six petitioners in this case. They have come up before this Court for issuance of a writ of mandamus directing the respondents inter alia, for consideration of their case for promotion to the post of Junior Engineer, which according to them are lying vacant since long. 2. The petitioners are holders of Diploma in Craftmanship. They have been appointed on the post of Surveyor in the Directorate of Soil Conservation. Patna (hereinafter 'the Directorate' only) on different dates as detailed in para 6 of the writ petition. It has been averred in the writ petition that some of the persons similarly situated to the petitioners have been promoted to the higher posts, but the petitioners have been denied the similar benefits. 3. The respondents have filed a counter affidavit in para 5 whereof it has been specifically stated that there is no post like that of Assistant Engineer or Executive Engineer in the Directorate. It has also been stated that in 1975 some persons holding Diploma in Civil Engineering and Survey from the Industrial Training Institute were promoted to the post of Junior Engineer on a purely temporary basis. But subsequently those promotions were objected to by the Finance Department of the Government on the ground that the post of Junior Engineer does not come under the ladder of promotion from the post of Surveyor or Senior Surveyor and, accordingly, such promotions were declared illegal and steps for recovery of excess payment from such persons are being taken. 4. Mr. Sahani appearing for the petitioners, faced with the above situation, has submitted that the petitioners are entitled for at least two time-bound promotions. But so far they have been given only one promotion. Mr. V. Shivnath appearing for the respondents submitted that if in law the petitioners are entitled to second time bound promotion, the same will be considered in. accordance with law and if the claim is found to be admissible, the same will be granted without any delay. 5. Keeping in view the facts and circumstances of the present case; it is hereby directed that the respondents shall consider the cases of the petitioners for their promotion as and when occasion arises if they are found suitable and eligible for the same.

It is also directed that if the petitioners are entitled to second time-bound promotion then if a representation is filed in this regard within two months from today setting out all the necessary facts then the same should be considered and disposed of within six weeks from the date of such filing in accordance with law. 6. The writ application is thus disposed of. No cost.
