ORDER : K. Ramaswamy, J. 1. Leave granted. 2. The appellant has been convicted for an offence under Sections 448 and 506 Part II, Indian Penal Code and sentenced to pay a fine of Rs 200 and Rs 300 respectively with usual default clause. The appellant states that he is a lecturer working in a Government college and the conviction would stand in his way for his continuance in Government service. The complainant Prof. S.C. Mowar, Professor in Zoology (Retd.) had also filed an affidavit stating that he is agreeable to compounding the offences. Indisputably these two offences are compoundable offences. Accordingly the offence is permitted to be compounded and the conviction and sentence are set aside subject to the condition that the appellant should pay a sum of Rs 3,000 to the Prime Minister's Relief Fund within a period of three months from today. In default of such payment the conviction and sentence stand revived. The fine if already paid will stand forfeited to the State. 3. The appeal is allowed and the appellant stands acquitted subject to the above observations. Appeal allowed.
