The purpose of compassionate appointment under the Rules is to provide prompt succour to the family members of the Government Servant dying in harness lest they are left destitutes. If the appointment on compassionate ground is denied on hyper technicalities, as in instant case, the very purpose of the compassionate appointment would stand frustrated causing serious miscarriage of justice prevention whereof is the prime goal of jurisdiction under Article 226 of the Constitution of India. ( 10 ) IN the result, the petition succeeds and is allowed.
