JUDGMENT : 1. Issue notice. 2. Mr. P. Parmeswaran, Advocate has accepted notice on behalf of the respondent. 3. Appeal admitted. 4. Heard the Counsel. Taking into consideration the facts and circumstances of the case, we consider it appropriate in the interest of justice that the appeal filed by the appellant before the Tribunal be heard on merits provided the appellant deposits the sum of Rs. 4,09,500/-, which was required to be deposited in the Tribunal, within a period of four weeks from today. If the appellant deposits the said amount within this period the order passed by the Tribunal would stand set aside and the appeal will be heard by the Tribunal on merits. In case the appellant fails to deposit the amount within the aforesaid period, this appeal shall stand dismissed. 5. Permission is granted to move the Tribunal for expeditious disposal of the case. 6. The appeal is disposed of accordingly.
