JUDGMENT 1. - This petition is under section 482, Criminal Procedure Code for quashing the order dated November 17, 1992 passed by the Learned Munsif and Judicial Magistrate, Gaddi, District Banswara dismissing the application of the petitioner for giving the truck No. G.J. 9/T/4899 in his custody. 2. It is contended by the Learned counsel for the petitioner that the truck is in police custody since its seizure in FIR No. 426/92. P.S. Gaddi dated 3-11-92, it is deteriorating, no useful purpose will be served in its continued custody in the police and it should be given in the custody of the petitioner who is its registered owner. He relies upon the decision of this court given in S.B. Criminal Misc. Petition No. 68/88 Ganesh Lal v. State decided on 25.9.88 . 3. Learned Public Prosecutor has no objection if the said truck given in the custody of the petitioner on his executing a surety - bond. 4. Under the facts and circumstances of the case, the petition moved under section 482 Criminal Procedure Code is alb wad. The order of Learned Munsif and Judicial Magistrate. Gaddi dated 17-11-1992 is quashed. He is directed to give the said truck in the custody of the petitioner on his furnishing security and undertaking to his satisfaction.Petition allowed. *******
