JUDGMENT : S.L.P.(C) No. 8392/93 :- Issue notice on S.L.P. as well as on application for stay, returnable on 19.7.93. No ad-interim stay having regard to the conduct of the petitioners. S.L.P.(C) No. 8391/93 :- Exemption allowed. Special leave granted. Issue notice on application for stay returnable on 19.7.93. Mr. S. Murlidhar, learned counsel, accepts notice on behalf of the 5th respondent. Liberty to the respondents to file affidavits in reply to the application for stay. In the meanwhile, there shall be an ad-interim stay of the operation of the impugned order in so far as the petitioner is concerned but this shall not entitle the petitioner to become either the Chief Minister or a Member of the Council of Ministers of the State of Goa. I am passing this ad-interim order, basically, for three reasons. (1) The Speaker, in the order impugned in the writ petition, did not take into account a stay order obtained from the High Court in favour of Mr. Chopdekar and Mr. Bandekar. (ii) The communications to the Speaker by Mr. Chopdekar were not made available to the petitioner so that he could meet them. (iii) The Speaker appears to have declined the application on behalf of the petitioner for even a day to produce the evidence of the seven members who, according to him, formed the break-away group with him.
