JUDGMENT 1. - Heard learned counsel for the petitioner and the learned Public Prosecutor for the State and also perused the documents on record. The petitioner was found in possession of 60 gms. of opium which includes the weight of polythene bag. The person who lodged the FIR is investigating this case. The petitioner is in custody from 1.8.1993. He was never convicted/involved in such offence earlier. This fact has not been controverted by the learned P.P. In this view of the matter, I am inclined to accept this application for bail. 2. In the facts and circumstances of the case and the arguments advanced by both the sides, I am inclined to grant bail under Section 439 Criminal Procedure Code to the accused petitioner. 3. It is, therefore, ordered that the accused petitioner Paramjeet Singh S/o Swaroop Singh shall be released on bail provided he furnishes a personal bond in the sum of Rs. 50,000/- (Rupees fifty thousand) with two sureties in the amount of Rs. 25,000/- each, to the satisfaction of the trial court with the stipulation to appear in that court as and when called upon to do so during the pendency of the trial against him in this case. *******
