JUDGMENT 1. - It is contended by the learned counsel for the accused - petitioner that main prosecution witnesses in this case are Vitthal, Dinesh and Pannalal, a case under section 376, Indian Penal Code have been filed against them for committing rape with Mithu, they have been released on bail by the learned Sessions Judge, Banswara and they were examined under section 161, Criminal Procedure Code after about 2 months of the occurrence. He further contends that Mithu's father Baling admitted in his statement that she was in love with the petitioner and was living with him for the last 6 months and there was no reason for the accused - petitioner to commit her murder. 2. Learned Public Prosecutor contends that separate challan has been filed against the aforesaid three witnesses under section 376, Indian Penal Code and they have nothing to do with her murder. 3. Under the facts and circumstances of the case, it is just and proper to release the accused - petitioner under Section 439, Criminal Procedure Code. 4. The accused - petitioner Manoj Kumar may be released on bail if he furnishes a personal bond in the sum of Rs. 10,000/- with two sureties in the sum of Rs 5,000/- each to the satisfaction of the Special Judge (S.C./S.T.), Banswara for his appearance.Bail granted. *******
