Judgment : This revision is directed against the order passed inCrl.M.P.No.6348 of 1992 on the file of the Principal Sessions Judge, Madurai, cancelling the bail, on the short ground that the accused was not complying withthe conditions from the date of order. 2. In Indirakumar and four others v. State represented by Inspectorof Police, Suchindram, 1991 L.W.(Crl.) 195, this Court has held that failureto comply within the condition simpliciter is not sufficient for thecancellation of bail unless there are circumstances pointing out that theaccused were interfering with the course of justice either by threatening thewitnesses or tampering with their evidence. No such circumstances are pointedout in the order of the court below. This ruling squarely applies to this caseand hence the order of the court below cannot be sustained and is liable to beset aside. 3. In view of the above, this revision is allowed, setting aside theorder of the court below passed in Crl.M.P.No.6348 of 1992 on the file of thePrincipal Sessions Judge, Madurai.
