JUDGMENT 1. - Prayers made in this writ petition are as follows : (a) by an appropriate writ,order or direction the respondents be directed to make payment of 100% pension,gratuity, Employees Provident Fund and refund deposits on account of membership of Teachers Welfare Society and Commutation of pension to the petitioner forthwith, (b) by an appropriate, writ,order or direction the respondents be directed to pay damages and interest at the rate of 18% per annum on the aforesaid due amount; (c) by an appropriate writ,order or direction, pending disposal of the writ petition,the respondents be directed to at least 80% of the gratuity amount,commutation of pension amount, E.P.F. amount and refund of deposits in respect of membership of Teachers Welfare Society etc.be paid to the petitioner; (d) any other appropriate writ,order or direction deemed just and proper in the interest of justice may also kindly be issued in favour of the petitioner; (e) the costs of this writ petition be awarded to the petitioner. 2. During the pendency of the writ petition, Shri Katta, learned counsel for the respondents had made a statement before the Court on 8.11.93 that 75% of the pension is being paid to the petitioner and the authorities are taking steps to pay full pensionary benefits to the petitioner on that ground. He had prayed for grant of five weeks' time. Today, he says that all retirement benefits are likely to be given to the petitioner in a period of six weeks from today. 3. Since the claim of the petitioner for grant of retirement benefits is not in controversy, I deem it proper to dispose of the writ petition by issue of a writ of mandamus to the respondents to give all retirement benefits/dues to the petitioner within a period of six weeks from today. It is expected that the University authorities will take prompt steps for compliance of this direction. 4. It is, however made clear that if any genuine difficulty is felt by the respondent University in giving full effect to the order in six weeks, they will be free-to make an application within four weeks from today. The Registry shall list the said application within 7 days of the same being filed. Similarly, the petitioner finds that some retirement benefit has not been paid to him within six weeks he shall be free to make application for further directions before the Court.
