JUDGMENT 1. This petition under section 482, Cr. P. C. has been filed against the order dated 28.1.93 passed by Muniff & Judicial Magistrate, Deeg, Distt. Bharatpur in Cr. Case No. Nil/93, whereby the petitioner's application under section 457, Cr. P. C. has been dismissed. 2. Mr. Naqvi has argued that the dispute is about the return of a rural vehicle named Jugad Bhugghi. It was seized by the police on account of being 'illegal vehicle' and was being used for carrying passengers on the road. Mr. Naqvi has invited my attention to the order dated. 24.4.92 passed by this Court in the case of Mohammad Saffi Vs. State of Rajasthan in which Nr. Naqvi himself had appeared against a similar order passed by the Munsiff & Judicial Magistrate, Nagar and Mr. S. R. Yadav had also appeared as Additional Public Prosecutor. Mr. Yadav has submitted that this case may also be decided in terms of this Court's order dated 24.4.92. Mr. Yadav has also submitted that it is a identical matter. 3. In these circumstances, it is ordered that the Jugad Bhugghi in question shall be returned to the petitioner on furnishing a 'superdiginama' for a sum of Rs 25,000/- ( र Twenty five thousand) and the petitioner shall use the Engine of this Jugad Bhugghi as an 'engine' only and shall not ply it has Jagad Bhugghi on the road or otherwise for any purpose whatsoever. 4. The order dated 28.1.93 is modified as above and this petition under section 482, Cr. P. C. is hereby disposed of as indicated above.Petition disposed of. *******
