JUDGMENT 1. - This petition was filed by the petitioner in person on 12th April, 1993 where in he has prayed that the trial- Court be directed to recall the order of arrest issued against him. Neither the copy of order has been placed on record nor. the date of the impugned order has been given in the petition. I wonder how the Registry cleared such file and listed the same before the Court, it ought to have been seen by the Stamp Reporter, that the copy of the impugned order which was required to be recalled should have been placed on record. In fact, the order can only be recalled by passing the order if he wants to move an application before this Court, the application should have been for setting-aside the impugned order of the lower- court. Thus, by no standard this case should have listed before the Court however, when the case was listed before my learned brother Hon'ble M.R. Calla, J. he passed an order for calling for the original record of the lower-Court, since record was already being showed, it would be travesty of justice in case, I throw away the file on these ground but it should be treated as a note of caution to all those persons working in the Stamp Reporter Section that the cases should be registered carefully. 2. It appears from the record of the case that the petitioner had been appearing in the Court earlier regularly and on his remaining absent, a warrant has been issued against him. Since, the offences alleged against the accused petitioner are for offences under Sections 452 and 352, I deem it proper to issue directions to the trial-court that when the accused petitioner appears before him, he shall forthwith be released him on bail on his entering into a personal bond in the sum of Rs. 5,000/- together with one surety in the like amount to his satisfaction. 3. The accused petitioner Ramesh Chand son of Govind lal is directed to appear before the trial-court on or before 1st March, 1994 till then the warrant issued against him shall not be executed.The record of the trial-court be sent back immediately.Direction issued. *******
