JUDGMENT : This appeal is directed against the order dated December 16,1991 passed by the Bombay High Court in Election Petition No. 23 of 1990. The only objection raised before us is that the High Court, instead of recording the evidence of each of the witnesses named by the respondent in the said Election Petition, has by the impugned order directed inter alia that the Examination- in-Chief of the witnesses of the respondent in the Election Petition would be commonly recorded as the name is identical and has been recorded in other Election Petitions where the issue is common. We are not inclined to interfere with the impugned order. It is open to the appellant to raise this objection and all other objections in this respect before the trial Court or before any other appropriate forum at the time of the trial. 2. The appeal is dismissed. No costs. Appeal dismissed.
