JUDGMENT 1. - A perusal of this writ petition shows that despite the order of this Court dated 21.10.1991 and direction given by the Joint Director, Medical & Health Service, Kota Range for giving effect to the orders of the Court passed in S.B. Civil Writ Petition No. 3600/88, the subordinate Officers of the Medical & Health Department have not implemented the court's order. Learned counsel for the petitioner says that the petitioner had earlier filed a contempt petition which was withdrawn on 24.1.1994. 2. In my opinion, when the court's order dated 21.10.1991 was clear and unequivocal it was not open to the subordinate officers to have disobeyed it. It is indeed unfortunate that despite directions issued by the Joint Director, the subordinate officers have not implemented the orders of this Court. Having taken note of the averments made in the writ petition, I am of the opinion that it is a fit case in which this Court should take notice suo moto action for implementation of the court's order notwithstanding the fact that the petitioner had earlier withdrawn the contempt. I deem it proper to take cognizance against the Chief Medical & Health Officer, Kota Range and the Medical Officer, Government Dispensary, Ayana, District Kota for initiation of contempt proceedings against them. 3. The writ petition is admitted, and at the same time, cognizance is taken against the Chief Medical & Health Officer, Kota Range and the Medical Officer, Government Dispensary, Ayana, District Kota as to why they should not be proceeded against under the Contempt of Courts Act, 1971. Let a notice be issued to respondents No. 4 to 5 to show cause as to why contempt proceedings be not initiated against them. The petitioner should send a certified copy of this order along with notice of the writ petition to respondents No. 1 to 5. Notices be given dasti.Writ Petition Allowed. *******
