body1994
JUDGMENT : 1. Leave granted. 2. Heard. 3. Shri P. Chidambram, learned counsel for the respondent in all fairness submitted rightly that the impugned order made by the Calcutta High Court is unsupportable. He very rightly did not make any attempt to support that order. Nor this reason, we need not say anything more on merits to indicate obvious infirmities in that order. We set aside the impugned orders of the High Court which results in dismissal of the writ petitions filed by the respondent in the High Court. 4. Shri Chidambram than submitted that the respondent apprehends the use of force against him during the inquiry even though the respondent has been fully cooperating with the authorities in this behalf. Mr. Chidambram submitted that a statement on behalf of the appellants assuring the respondent of full protection of his rights would go a long way in giving to the respondent the needed assurance. All that we need observe in this connection is that the learned Additional Solicitor General promptly, in all fairness reciprocated by making a statement that the constitutional rights of the respondent would be duly protected. This statement is placed on record. 5. The appeals are allowed in the manner aforesaid.
