Pyaribai v. State of Maharashtra

1994-02-18

G.N.RAY, K.JAYACHANDRA REDDY

body1994
JUDGMENT : 1. Special leave granted. 2. The appellant, Smt. Pyaribai, mother-in-law has been found guilty by the High Court under Section 498-A I.P.C. and sentenced to six months' R.I. and to pay a fine of Rs. 1,05,000/- in default of payment of which to suffer further R.I. for nine months. 3. Having gone through the records, we think that the ends of justice will be met if the sentence of six months' R.I. is reduced to four months' R.I. Accordingly, it is reduced to four months' R.I. The sentence of fine is, however, confirmed but in default of payment of which we reduce the sentence of nine months R.I. to four months' R.I. 4. Mr. A.K. Sanghi, learned counsel for the appellant submits that the High Court in the impugned order has given further directions in respect of investments to be made for the benefit of three children of Vimla and that the guardian of the children shall be P.W.17 and in respect of the investments for four minor children of Narmala and that the guardian shall be P.W.9 and that these directions are unwarranted. However, we think it is not for us to interfere with these directions. It is open to the appellant to move the High Court for further necessary directions in accordance with law in this regard. 5. The appeal is disposed of accordingly.
