JUDGMENT 1. - This appeal is directed against the judgment dated 20-7-1993, passed by the Sessions Judge, Sirohi, by which the learned Sessions Judge convicted the accused for the offences under Sections 323 and 325/34 I.P.C. and instead of sentencing them at-once, gave them the benefit of probation and imposed the fine of Rs. 600/- each of the accused and directed to pay a sum of Rs. 2000/- to the injured out of this amount. 2. I have heard the learned counsel for the appellant and perused the judgment passed by the Court below. 3. Accused-respondents Dhan Singh, Lal Singh, Jet Singh, Nop Singh and Nab Singh were tried by the learned Munsif and Judicial Magistrate, Sirohi, for the offences under Sections 147, 148, 342, 323 and 325 I.P.C. The learned Magistrate, after trial, acquitted accused-respondents of the offences under Sections 147 and 148 I.P.C. and further acquitted accused-respondent Nop Singh of the offence under Section 342 I.P.C. but convicted accused Dhan Singh for the offences under Sections 325, 323 and 342 I.P.C. and accused Lakh Singh, Jet Singh, Nab Singh and Nop Singh for the offences under Sections 325 and 323 I.P.C. and sentenced each of them to three month's simple imprisonment and a fine of Rs. 100/- for the offence under Section 323 I.P.C. and six month's imprisonment and a fine of Rs. 200/- for the offence under Section 325 I.P.C. and in default of payment of fine to further undergo fifteen days and one month's simple imprisonment for the offences under Sections 323 and 325 I.P.C., respectively. Accused Dhan Singh was, also, awarded the sentence of two month's simple imprisonment for the offence under Section 342 I.P.C. Dissatisfied with the conviction and sentence, passed by the learned Magistrate, the accused preferred an appeal before the learned Sessions Judge, Sirohi. The learned Sessions Judge maintained the conviction of the accused-respondents but gave the benefit of probation under the Probation of Offenders Act, 1958, for maintaining peace and be of good behaviour and imposed the fine of Rs. 600/- on each of the accused-respondents and directed for payment of Rs. 2000/- out of this amount of fine to injured- appellant Babu Lal. 4. I have perused the judgment passed by- the Courts below. The learned Sessions Judge has rightly granted the benefit of probation to the accused-respondents looking to the modern reformative trend. No interference is called-for. 5.
