JUDGMENT 1. - This miscellaneous petition is directed against the order dated 14-7-1993, passed by the Additional Sessions Judge, Phalodi, by which accused Smt. Kesar Devi was granted anticipatory bail. 2. A case under Section 304-8, I.P.C. was registered against Mohan Lal, Smt. Kesar Devi, Sunil Kumar and Amit on account of death of Smt. Krishna caused by burns on 26-6-1993. This case was registered at Police Station Phalodi. All the aforesaid accused filed an application for the grant of anticipatory bail. The application for grant of anticipatory bail, so far as accused Mohan Lal, Sunil Kumar and Amit are concerned, was dismissed by the learned. Additional Sessions Judge, Phalodi, but, however, looking to the facts and circumstances of the case, Smt. Kesar Devi (respondent No. 2) was granted anticipatory bail on her furnishing a personal bond in the sum of Rs. 5,000/- with one surety in the like amount. 3. The cancellation of the bail has been sought on the ground that looking to the allegations made against Smt. Kesar Devi regarding harassment caused to the deceased and cruelly treating her for the demand of dowry and looking to the fact that her daughter-in-law Smt. Krishna died an unnatural death, the learned Additional Sessions Judge was not justified in granting anticipatory bail to her. The State did not raise any grievance regarding grant of bail to Smt. Kesar Devi and the present application for cancellation of bail has been filed by the complainant. The accused-respondent has not mis-used the liberty granted to her and even otherwise, a perusal of the order granting bail shows that the learned Additional Sessions Judge has not committed any illegality in granting anticipatory bail to Smt. Kesar Devi. No case for cancellation of the bail has been made-out. 4. In the result, the application for cancellation of the bail granted to accused-respondent Smt. Kesar Devi, has got no merit and the same is hereby dismissed.Petition dismissed. *******
