JUDGMENT : 1. Mr. F.S. Nariman, learned senior counsel appearing in some of the matters before us has invited our attention to questions (i) and (ii) in the reference under consideration. According to him, the questions are worded broadly and give the impression that the Bench is re-considering the questions which have already been decided by this Court in Kerala Education Bill ( AIR 1958 SC 956 ) and St. Xavier's College ( 1992(1) SCC 558 ) case. We make it clear that the reference does not include any of the questions which have been settled by the larger benches. Nevertheless, it is necessary to reframe the first two questions for proper adjudication of the issues. We adjourn the hearing of these matters to 18.3.1994. We would also like to hear the learned counsel on the questions for appropriate interim directions.
