JUDGMENT 1. - This revision application arises out of suit in which admittedly a person who was dead on the date when the suit was filed was impleaded as one of the defendants. 2. By the impugned Order, the trial Court has allowed the application under Order 6, Rule 17 of the Code of Civil Procedure allowing substitution of legal representatives of deceased-defendant in his place. 3. The amendment application besides being opposed on the ground that the legal representatives of a person already dead prior to filing of the suit cannot be brought on record by way of amendment was also opposed on the ground that if the suit had been brought on the date on which the amendment application had been filed, it would have been barred by limitation. 4. The learned counsel for the applicant submitted that a suit against a dead person is a nullity and the legal representatives of such person cannot be substituted by resorting to Order 6 Rule 17 of the Code of Civil Procedure. 5. No one appeared for the non-applicant despite service. 6. I heard the learned counsel for the applicant and on perusal of the record I find that the trial Court has committed an illegality in allowing the legal representatives of a defendant who was not alive on the date when the suit was filed to be brought on record by allowing the application under Order 6, Rule 17 of the Code of Civil Procedure, moved for the purpose. Without doubt a suit against a dead person is a nullity and only because the suit is also against some other defendants, the plaintiff cannot be allowed to substitute the legal representatives of such a deceased-defendant by way of amendment of the plaint. (See Joginder Singh v. Krishna Lal, AIR 1977 Punj & Hary 180). 7. I therefore, allow the revision application and set aside the impugned order of the trial Court. The trial Court shall proceed further after deciding whether the suit as originally framed is maintainable against the other defendants and pass orders in accordance with law. 8. There shall be no order as to costs.Petition allowed. *******
