JUDGMENT The appeal is directed against the judgment and decree dated 13.12.1971 of the Additional Judge to the Court of the District Judge, Mandleshwar in Civil Suit No. 1-B/71, whereby the plaintiff-appellants suit has been dismissed on preliminary issues. The brief history of the case is that the plaintiff had filed the suit for recovery of Rs. 85,000/- against the defendant on the ground of excess payment had been made to the defendant, who was a contractor in construction of a dam. The defendant raised certain preliminary objections regarding maintainability of the suit and limitation as well The learned trial Judge framed 14 issues but dismissed the suit only on issues nos. 10, 11 and 12, which are as follows :- "Issue No. 10: Whether the plaintiffs are entitled to Rs. 10,191/- by way of interest at the rate of 6% p.a. by way of damages? Issue No. 11: Whether there is no liability on the State of M.P. to pay this amount even if found due? and Issue No. 12: Whether relict" can be granted to the plaintiffs?". So far as issue No. 12 is concerned, that appears to be erroneous on the face of it as limitation for the suit by the State Government is 30 years as per Article 132 of the Limitation Act, 1963. Issue No. 10 is regarding the objections to whether the plaintiff has cause of action. This requires evidence. As the matter could not be decided without evidence and the learned trial Judge committed an error in jumping to the conclusion without asking for the evidence by the parties. Issue No. 11 deals with the question of the authority of the Executive· Engineer, who signed the contract. This again would require some evidence. The party can show delegation of power to the Executive Engineer. That opportunity was not given to the plaintiff. We accept the appeal. The judgment and decree of the trial Court is set aside and the file is remanded back to the District Judge, Mandleshwar with a direction that he may himself or by any other competent Add 1. District Judge get the suit decided within six months from today after giving an opportunity of adducing 'evidence on all the issues. The file be sent back to the District Judge, Mandleshwar by keeping a separate note-sheet regarding return of the file.
