LAXMAN SINGH v. GOVIND VALLABH PANT GRIH NIRMUN SAMITI

body1994
T. S. DOABIA, J. ( 1 ) HEARD. The grievance of the petitioner is that a dispute under Section 64 of the M. P. Cooperative Societies Act was referred for adjudication to the respondent No. 6. The counsel states that this dispute is pending since March 1993 as no functionary is holding the office. According to him, the respondent No. 6 cannot hear the dispute because he was also looking after the affairs of the society when it was under supersession. I have considered the matter and am of the view that the petitioner should approach the higher authorities under the Act referred to above by filing a representation along with a copy of the order of this Court and copy of writ petition with Annexures. In case such a representation is made within 15 days from today, the respondent authorities shall pass appropriate orders on it within a period of four weeks. This period of four weeks would commence from the date of the receipt of the representation and other documents mentioned above. The question as to whether respondent No, 6 can decide the dispute or not would also be open and in case it is found that there is no impediment in his deciding the dispute, then the competent authority would be at liberty to pass such order as may be found appropriate. ( 2 ) IN case, the joint Registrar feels any difficulty in disposing of the representation within the aforementioned period, he would be liberty to approach this Court for extension of time. C. C. on payment of usual charges. .
