JUDGMENT 1. - A prayer has been made for quashing the proceedings pending before the Additional District Magistrate, Alwar under Section 110 Cr.P.C. in case No. 18/428, in this petition under section 482, Cr.P.C. 2. The order dated 5-8-1991 passed by Additional District Magistrate (city), Alwar along with list of cases and the record received from the Additional District Magistrate, Alwar have been perused. 3. I have considered over the matter. For the purpose of invoking the power under section 110 Cr.P.C. it is necessary that all the ingredients mentioned in the Section must exist. The order passed on 5-8-1991 does not disclose the existence of circumstances contemplated under section 110 and, therefore, it will be in the interest of justice that the matter be sent back to the Additional District Magistrate (city), Alwar for deciding the issue a fresh taking into consideration the existence of the requirements for invoking the power under section 110, Cr.P.C. 4. Consequently, the misc. petition is partly allowed as aforesaid.Petition accepted. *******
