JUDGMENT 1. - Accused-petitioner Havji Sio Kodra, present before me, who is being identified by Shri BS. Rathore, Advocate holding the brief of Shri Doongar Singh, Advocate. 2. The petitioner is admonished and he expressed his regret. From his behaviour, I am satisfied that he is repenting for the offence committed by him under Section 380, 'PC. 3. Nothing has been brought to my notice which could, indicate that the petitioner is a previous convict. 4. Having regard to all the facts and circumstances of the case including the nature of the offence and period spent from the date of conviction up til the date, it would be expedient to release him on probation of go-1 conduct for a period of three months. 5. The petitioner is an old illiterate man belonging to Scheduled Caste Community and from his appearance, it appears that he is extremely poor and helpless. 6. Mr. B.S. Rathore, learned counsel for the petitioner gives an undertaking on behalf of the accused-petitioner that he will maintain good conduct for a period of three months. 7. In view of the aforesaid facts and circumstances of the case, taking legal and human consideration, I hereby release the accused-petitioner Havji S/o Kodra under Section 4 of the Probation of Offenders Act, 1958 and the instant petition under Section 397/401, Cr.P.C. is hereby finally disposed of.Revision allowed. *******
