JUDGMENT Contention of Shri N.D. Tiwari is that there was motive of committing the said offence on the part of the both accused/petitioners and that one axe was found at the instance of the petitioner No. 1. It has to be seen that motive by itself is not a conclusive evidence for alleged commission of offence and the said offence can merely lend support to the other evidence available on record. The axe was recovered after lapse of one year after finding the dead body of Mahip Singh. The said recovery and seizure had absolutely no meaning or evidential value in the present case. Looking to the said circumstances, the petitioners on their each executing a personal bond of Rs. 10,000/- with two solvent sureties of Rs. 5,000/- each to the satisfaction of CJM Sagar, they shall be released on bail. A copy of thin order be sent to the Court concerned.
