JUDGMENT : 1. On January 17, 1990, this Court directed to conduct two lotteries for the benefit of the petitioner and further directed that "the proceeds of two such draws earmarked before shall be disbursed to the petitioners". Pursuant thereto, admittedly, the State Government had conducted lotteries on 22.3.90 and 31.3.90 in which a sum of Rs. 3 lakhs was collected. In the letter dated July 22.9.82, the Dy. Secretary to the Government had stated that: "Accordingly two draws were conducted: The actual disbursement of the net proceeds of the above two draws to the society would be only after the final orders passed by the Supreme Court." We are at a loss to understand how the officers could pass this order in the face of specific directions issued by this Court on January 17, 1990. Therefore, it is not in dispute that' a sum of Rs. 3 lakhs was realised in conducting these two lotteries on the respective dates put together. The State Government is, therefore, directed to disburse the said sum of Rs. 3 lakhs immediately within a period of 4 weeks from today to the petitioner's Society. Since the matters have been posted before the Constitution Bench, this Writ Petition also is directed to be posed along with T.C. No. 70/90 and connected matters before the Constitution Bench. 2. Learned counsel for the petitioner sought to contend that the petitioner requires still further amount. We cannot give any further direction in the absence of any specific petition in that behalf.
