JUDGMENT 1. - This Leave to Appeal is directed against the judgment dated 3-4-93, passed by the Special judge, N.D.PS. Act Case, Jodhpur. 2. Accused-respondent Hari Ram and co-accused Mool Singh were tried by the learned Special Judge, N.D.PS. Act Cases, Jodhpur, for the offences under Section 8/17, 18, 21, 23, 27-A and 29 of the Narcotic Drugs and Psychotropic Substances Act. The case of the prosecution is that on 30-11-91, in the field of Mool Singh Rajput, under a Kherji tree, the opium milk weighing 4 kgs. 480 grams was recovered at the instance of the accused and he was found engaged in the sale and purchase of the opium. The prosecution, in support of its case, examined two Motbir Witnesses, viz., l' W 1 Hari Singh Rajpurohit and DW 2 Hari Singh Rajput, DW 3 K.C. Vyas, 11W 4 K.V. Nasir, PW 5 J.L. Kapoor and DW 6 Yogesh Kumar. The accused examined DW 1 Bhinya Ram, DW 2 Mool Singh, DW 3 Narain Singh and DW 4 Mangi Lal. The learned trial Court, after trial, came to the conclusion that the recovery of the opium was made from the field and from the evidence produced by the prosecution it has not been proved that the field was in the exclusive possession of the accused. He, therefore, acquitted the accused-respondent. 3. I have perused the judgment passed by the Court below. 4. The acquittal of the accused by the trial Court cannot be said to be, in any way, illegal. The learned trial Court has considered the case in the right perspective and the appreciation of the evidence, made by the learned trial Court, cannot be said to be, in any way, arbitrary or unjust. The judgment, passed by the learned lower Court, acquitting the accused- respondent, thus, does not require any interference. 5. In the result, I do not find any merit in this Leave to Appeal and the same is hereby dismissed. The Leave prayed-for is refused.Leave to appeal dismissed. *******
