JUDGMENT Shri Tiwari informs that the case-diary has not been received. Shri S.L. Kochar states that the accused/petitioners placed in the similar circumstances, have been ordered to be released on bail by order dated 8.7.1993 passed by Hon'ble Tamaskar J. of which Shri S.L. Kochar filed a certified copy. Since an opportunity has already been granted to the prosecuting agency and copies of the documents filed along with challan are available, the petition is being decided on the basis of arguments advanced by Shri Kochar on the basis of the said documents. Looking to the allegations levelled against the present petitioners, it appears that the petitioner No. land 2 took the leading roll in the incident and the incident took place in the house of the petitioner No. 1. As such, the petition filed by petitioner No.1 and 2 is rejected. The petition filed by petitioner No.3, 4, 5 and 6 who are similarly-placed as Ram Prasad and Mahat Lal, as far as the present case is concerned, their petition is allowed. Consequently, it is ordered that on the petitioner No.3, Narulal, Petitioner No.4, Radhelal, Petitioner No.5, Dhani Ram and Petitioner No.6, Preetamlal, each executing a personal bond of Rs. 10,000/- with two solvent sureties of Rs. 5,000/- each to the satisfaction of OM Balaghat, they shall be released on bail. A copy of this order be sent to the Court concerned.
