JUDGMENT This is a petition under Article 227 of the Constitution of India. It is directed against the order passed by the 1st Additional Judge to the Court of District Judge, Vidisha. The order was passed of 18th October 1989. It arises out of the following facts: Suit was filed by Prahlad Singh, who figures as respondent No. 1 in this petition. The suit was for declaration and injunction that the possession of the plaintiff may not be disturbed. An application was also filed under Order 39 Rules 1 and 2 of the C.P.C. The trial Court refused the injunction. The first appellate Court has, however, reversed the order of the trial Court and granted the injunction. The defendant is aggrieved against the order passed by the first appellate Court. There is no jurisdictional error. The petition is accordingly dismissed with no order as to costs.
