JUDGMENT : N.N. Mathur, J. This appeal is preferred by the State against the order of acquittal passed by the Chief Judicial Magistrate, Palanpur, dated 19.12.1986 in Summary Case No.1981/ 1984. The Prosecution case is that, Food Inspector visited the shop of the accused on 20th March, 1984 and purchased 3 Kilograms of Turmeric powder for the purpose of analysis. The sample was sent to the Public Analyst in accordance with the provisions of the Prevention of Food Adulteration Rules. In the opinion of the Public Analyst, the sample of Turmeric powder was mixed with rice starch and did not conform to the standard as prescribed under the provisions of Prevention of Food Adulteration Rules. 2. The learned Magistrate disbelieved the statement of the complainant on the ground that his statement was not supported by Panch PW 2, Bhimjibhai Tuljibhai. 3. 1 have heard the learned Additional Public Prosecutor for the State and also gone through the record. It cannot be a rule that the statement of the complainant cannot be relied as the same is not supported by the Panch. However, I am not inclined to take a different view from the one taken by the learned Magistrate on the appreciation of evidence. In the result, there is no merit in the appeal and the same is dismissed. Appeal dismissed.
