State of Andhra Pradesh v. Poonaluru Rajeswaramma

1994-05-10

KULDIP SINGH, N.P.SINGH, P.B.SAWANT

body1994
JUDGMENT : 1. Mr. Venugopal, learned senior counsel appearing for the respondent has raised an interesting question of law. According to him the High Court was exercising jurisdiction under Section 21 of the Andhra Pradesh Land Reforms (Ceiling an Agricultural Holdings) Act, 1973, which power is parimateria to that of Section 115 of Civil Procedure Code. According 1o Mr. Venugopal while exercising power under Section 136 of the Constitution of India in this case our jurisdiction cannot be wider than that of the High Court which was exercising revisional jurisdiction. On the other hand Mr. Chari, learned counsel for the State of Andhra Pradesh states that under Article 136 when once special leave is granted, this Court has much wider power and it can reach injustice wherever it lies. Since elaborate arguments have to be addressed on this point, at the request of learned counsel, we adjourn these cases to August 2, 1994 before a Three Judge Bench. The matters are released from part-heard.
