JUDGMENT This is a petition under Articles 226 and 227 of the Constitution of India. This arises out of the following facts. The workman respondent No. 1 filed a petition seeking classification as Booking Agent. This classification is being sought not at the initial stage but at promotional stage. The learned counsel appearing for the respondent No. 1 has raised a preliminary objection that the petition is belated and as it has been filed after a period of more than two years. According to him the same deserves to be dismissed on the ground of delay and latches. According to him, the order under challenge was passed on 22nd of March, 1991 and this petition was filed in July 1993. This argument is without merit as benefits already accrued to the respondent are not being touched. It may he seen that the question as to whether the workman is entitled to classification at a stage which is not the initial stage was examined by a Full Bench of this Court in M.P. No. 527/90 (M.P. State Road Transport Corporation v. Narayan Singh Rathore and others) decided on 17.8.1994. It was observed that classification can be done at the initial stage. However, a direction was given that the period during which the workman discharged the duties attached to the higher post, he shall be paid emoluments attached to the higher post. This petition is disposed of in terms of the direction given by the Full Bench in the above referred decision. It is held that the petitioner was not entitled to be classified as a Booking Agent in pursuance of the order passed by the Industrial Court as the classification was not done at the initial stage. However, as indicated above, the monetary benefits which have already accrued to him will not be questioned. The argument of the respondent No. 1 that the Corporation has already implemented the order and, therefore, it cannot challenge action is again devoid of merit as the Corporation had no option but to implement the order passed by the Industrial Court. This argument as such has no merit. The petition is disposed of as indicated above.
