JUDGMENT Pandya informs that the case diary has not been received. The order rejecting the petition for releasing the petitioners on bail under section 438, Cri. Pro Code, passed by the S.J., Chhatarpur, perused. It has to be seen on 7.5.93, it was ordered that the petitioners be not arrested in connection with the present offence. The incident had allegedly taken place in the first week of April 1993. A time of about nine months has elapsed after the incident. Looking to the said fact, the present petition is allowed and it is directed that in the event of arrest of the present petitioners' inconnection with crime No. 11 of 93 of police-station Ishanagar, dist. Chhatarpur, for alleged commission of offence punishable under section 3 (1) (2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, the present petitioners shall be released on their executing a personal bond of Rs. 5,000/- each with one surety of the same amount each, to the satisfaction of the police officer arresting them or anyone of them. A copy of this order be sent to Station Officer, Police Station, Ishanagar, Dist. Chhatarpur.
