SAT PAL ( 1 ) THIS is a petition under Section 276 of the Indian Succession Act for grant of Probate and Letter of Administration of the Will dated 29th March, 1976 executed by late Smt. Bimla Rani. ( 2 ) THE brief facts of the case are that the petitioner herein is the husband of late Smt. Bimla Rani. The deceased Bimla Rani had executed a Will dated 29th March, 1976 in accordance with law. In terms of the said Will the deceased bequethed all her moveable and immovable properties, cash bank balance and all assets and liabilities, jewellery and Istridhan in favour of her husband Shri Ram Nath Monga, petitioner herein. The original Will alongwith its true English translation and the death certificate of deceased Smt. Bimla Rani have been filed alongwith the petition. ( 3 ) PETITION was directed to be registered on 11. 7. 89 and the notice was issued to the Chief Revenue Controller Authority and relations of the deceased Smt. Bimla Rani mentioned at Sl. No. 2 to 9 of para 7 of the petition. It was also directed that the citation be published in the newspaper statesman for the next date of haring i. e. 25. 8. 89. Pursu- ant to the aforesaid order notice has been published in the newspaper statesman dated 10th August, 1989. ( 4 ) RELATIONS No. 7 and 9, namely, Shri Pran Nath Monga and Devinder Kumar Monga appeared before the D. R. on 25. 8. 89 and stated that they did not oppose the grant of probate in favour of the petitioner. The statement of Smt. Savita Malhotra, relation No. 6 was recorded by the Dy. Registrar on 26th October, 1989 and in her statement she also stated that she had no objection if the probate was granted in favour of the petitioner. ( 5 ) THE order passed by the D. R. on 4. 4. 90 shows that the relations at Sl. No. 2,3,4 and 5 were served and Mr. Kirti Uppal, Advocate put in appearance for relation No. 2, but none appeared on behalf of relations No. 3,4 and 5 despite service. Subsequent orders show that various opportunities were granted to the aforesaid relations but none of them has filed any reply. ( 6 ) ON 29. 10. 93 the statement of Mr.

Monga (relation No. 7) Shri Davinder Kumar Monga (relation No. 9) Shri Lakshmi Shankar Monga (relation No. 8) were recorded. ( 7 ) SHRI P. N. Monga, who is one of the sons of the deceased Bimla Rani has proved the execution of the Will dated 29. 3. 76 which is Ex. Public Witness. 1/2 and its true English translation which is Ex. Public Witness. 1/3. He has also proved the death certificate of Smt. Bimla Rani which is Ex. Public Witness. 1/1 and the affidavit of one of the attesting witnesses namely. Shri Chaman Lal which is Ex. Public Witness. 1/4. He has stated in his statement that the Will Ex. Public Witness. 1/2 was duy attested by two witnesses, namely, Shri Shanti Swarup and Shri Chaman Lal. He also stated that he had approached the Collector Ludhiana who informed him that the valuation certificate in respect of property involved in this case had been sent to Delhi High Court and at his request he supplied a copy of the said certificate to him which is marked Public Witness. l/a. He further stated that Probate be granted in terms of the prayer made in the petition. The facts stated by Shri P. N. Monga have been reiterated by Shri Davinder Kumar Monga and Shri Lakshmi Shankar Monga. ( 8 ) THERE is no opposition to this petition. In view of the averments made in the petition and the statements of the witnesses recorded on 29. 10. 93, e petition is allowed. The probate is granted to the petitioner in respect of the Will dated 29th March, 1976 Ex. Public Witness. 1/2 true English translation which is Ex. Public Witness. 1/3) subject to his furnishing requisite court fees and administrative bond with one surety in accordance with law. With this order, the petition stands disposed of with no order as to costs.
