JUDGMENT 1. :- Heard. Perused the challan papers. It is alleged that on receiving the credible information on 19.8.94, Kuber Singh, S.H.O., P.S., Dungla went to the field of petitioner Vardi Chand Baori and found that in his field, where vegetable was growing, ten plants of 'Charas' were also standing. Accordingly, he seized those plants and arrested the petitioner, who was sitting on the well nearby, for the offence under Section 8/20, Narcotic Drugs And Psychotropic Substances Act. The I.O. has not cared to record the statement of Patwari Halka. The Jamabandi of Samvat 2047 to 2050 of village Lakhmipura shows the joint tenancy of Pemchand, Gopi, Onkar, Prabhu and Chuna sons of Herlal Baori. In the Khasra Girdawari of Samvat 2047 also, the land bearing khasra Nos. 421 to 423 and 428 has been shown in their joint cultivation. The contention of Mr. Rastogi is that from the evidence collected by the I.O., it does not stand established that the petitioner has cultivated the said ten plants of 'Charas' or that the said field was in his exclusive possession. 2. Therefore, keeping in view all the facts & circumstances of the case, but without commenting on merits of the case and also keeping in view the provisions of Section 37 of the Narcotic Drugs And Psychotropic Substances Act, I feel that it is a fit case wherein petitioner should be enlarged on bail. Accordingly, it is ordered that petitioner Vardhi Chand Baori shall be released on bail provided he executes his personal bond in the sum of Rs. ten thousand and furnishes two sound & substantial sureties in the sum of Rs. five thousand each to the satisfaction of learned Special Judge, Narcotic Drugs And Psychotropic Substances Cases, Nimbahera for his personal appearance before that court on each and every date of hearing till the completion of the trial. He shall also give a written undertaking that he shall keep peace and be of good behaviour and shall not commit any offence punishable under the Narcotic Drugs And Psychotropic Substances Act during the trial of this case.Application accepted. *******
