JUDGMENT The applicant Raju alias Rajendra Shrivastava is involved in a case Crime No. 254/94, u/S. 302/34 of the I.P.C. of P.S. Gwalior, District Gwalior. Perused the F.I.R., Post-mortem report and other papers. The applicant is said to have fired his gun in the incident causing injuries to the deceased. The applicant is a licensee of gun SBBL No. 34477 of 86 of Licence No. 96 of 86. This gun was said to have been deposited at the dealer's shop Chetram Jail and Sons in safe custody on 24th of May, 1994 at 10 A.M. A photocopy of the deposit certificate has been produced before this Court by the applicant which is kept on record. This certificate shows that the gun of the applicant was already deposited on 24th of May, 1994 and the same could not be used on the date of occurrence which took place on 27th of May, 1994. This creates doubt regarding the use of the gun by the applicant. In these circumstances of the case, the applicant is entitled for bail. The applicant is admitted to bail on his furnishing a personal bond for Rs. 25,000/- with one surety bond in the like amount to the satisfaction of the C.J.M., Gwalior. The applicant is directed to appear before the C.J.M., Gwalior on 15.11.1994 and on such other dates as may be fixed by that Court thereafter.
