JUDGMENT 1. - This revision petition is directed against the order dated 11.10.94, passed by the Special Judge, N.D.P.S. Cases, Jodhpur, by which the learned Special Judge dismissed the application dated 7-10-94, filed by the petitioner, and refused to i recall witness Jagdish Chandra for cross-examination. 2. The contention of the learned counsel for the petitioner is that the petitioner's counsel Mr. Gulam Mustafa Khan, on 17-10- 94, had gone to Jaisalmer in connection with some case and in his absence the evidence of Jagdish Chandra was recorded. A request was made by his junior for allowing some time to the accused to cross-examine the witness but the learned Special Judge refused to grant time and closed the evidence, due to which the petitioner has been deprived of his valuable right to cross examine the witness. The learned Public Prosecutor, on the other hand, has supported the order passed by the Court below. 3. I have considered the submissions made by the learned counsel for the parties . 4. Six opportunities were given to the prosecution to examine these witnesses and it is after six opportunities that witness Jagdish Chandra appeared and his statement was recorded and on that day learned counsel for the accused had gone to Jaisalmer in connection with some case and, therefore, the learned Special Judge should have granted some time to the accused to cross-examine the witness. When six opportunities were granted to the prosecution to produce the witness and the witness appeared in the Court after a long delay then the accused should not have been deprived of his right to cross-examine the witness. The order passed by the learned Special Judge, therefore, deserves to be quashed and set aside and the accused should be given an opportunity to cross-examine the witness. 5. In the result, the revision petition, filed by the petitioner, is allowed and the accused-petitioner is granted one opportunity to cross-examine prosecution witness Jagdish Chandra. Witness Jagdish Chandra may be recalled and the accused be allowed an opportunity to cross-examine this witness.Revision allowed. *******
