ORDER : By this application, the applicant-Union of India prays that First Appeal No. 10 of 1980 from the file of the High Court Allahabad, Lucknow Bench be withdrawn to this Court for hearing and disposal. We do not consider it proper to withdraw the appeal to this Court. 2. We, however, direct a transfer of the appeal from the Lucknow Bench to the Allahabad Bench of the Allahabad High Court and request the learned Chief Justice of the Allahabad High Court either to take up the matter himself in his Bench and dispose of the appeal expeditiously or list it before an appropriate Bench of the High Court. We request the learned Chief Justice to ensure that the appeal is disposed of within two months from the date of the receipt of this order. 3. Sri Subba Rao, learned counsel for the appellant, states that Sh. Chiranji Lal Jaiswal, respondent in the said appeal is since dead and that an appropriate application for substitution of the Legal Representatives would be made before the High Court within two weeks from today. 4. The original records of the first appeal summoned from the High Court shall be sent back to the High Court immediately by the Registry. Ordered accordingly.
